Most companies are handling it the same way they handled GDPR. Ignoring it until the last possible moment, then scrambling. The GDPR scramble cost European businesses an estimated 9 billion euros in compliance costs in 2018 alone, with significant penalties flowing to organizations that were clearly unprepared.
AI regulation will cost more. The scope is broader. The stakes are higher. And unlike GDPR, which was primarily about data you collect, AI regulation is about decisions you make. That makes it harder to scope, harder to audit, and harder to argue you did not know.
I am not writing this to make you anxious. I am writing this because the companies that get ahead of compliance are not just avoiding risk. They are building competitive advantages. And I want you to understand why that is true before I explain what to actually do.
The EU AI Act is the anchor document. It became enforceable in stages through 2025-2026 and represents the most comprehensive AI regulation framework in the world. If you serve European customers, it applies to you regardless of where your company is headquartered. Same jurisdictional reach as GDPR.
The Act uses a risk-based tiering system:
Prohibited AI (banned outright): Social scoring systems, real-time biometric surveillance in public spaces, systems that manipulate people using subliminal techniques. Most legitimate businesses do not need to worry about this tier.
High-Risk AI: This is the tier that matters for most builders. The list includes AI systems used in healthcare diagnostics, financial lending decisions, hiring and employment, educational assessment, critical infrastructure, law enforcement, and border control. High-risk applications face extensive requirements: conformity assessments, risk management documentation, bias testing, human oversight mechanisms, transparent decision-making records, and mandatory registration in a public EU database.
Limited-Risk AI: Transparency requirements. Chatbots must disclose they are AI. Deepfakes must be labeled. AI-generated content in certain contexts must be marked. Relatively easy to implement but easy to overlook in product development.
Minimal Risk: General purpose AI use with no specific requirements beyond good practice.
The penalty structure should concentrate minds: up to 35 million euros or 7% of global annual revenue for the most serious violations, 15 million euros or 3% for less severe violations.
The US regulatory approach is fragmented and intentionally less prescriptive, but do not mistake "less prescriptive" for "low risk." State-level AI legislation is proliferating. Industry-specific regulators are applying existing authority to AI decisions. The enforcement actions will come.
When GDPR was announced in 2016 with a two-year implementation window, most companies fell into three categories.
Category one: took it seriously immediately, built compliance infrastructure, trained staff, changed product design. Expensive upfront. Smooth when enforcement arrived.
Category two: waited until 2018, scrambled, built barely-minimum compliance, paid significant penalty risk. Expensive and messy.
Category three: ignored it, assumed enforcement would be light or would not reach them. Some of these companies were right. Many were wrong in expensive ways. The 50 million euro fine against Google in France in 2019 established that size offered no protection.
AI regulation is following the same pattern. Companies that start now will have smooth implementations and will build compliance as a product feature. Companies that wait will scramble with higher costs, worse outcomes, and real penalty exposure.
The difference from GDPR: AI compliance is harder to achieve by checklist. GDPR compliance could largely be accomplished through privacy policies, consent mechanisms, and data handling procedures. AI compliance requires ongoing evaluation of model behavior, bias testing, and process design. It is a continuous operation, not a one-time project.
Let me be concrete about what the EU AI Act requires for high-risk applications, because the abstract language in the Act obscures what is actually needed.
You need to know and be able to explain:
Most companies cannot answer these questions completely right now. AI adoption has been organic and decentralized. Marketing uses one tool. Engineering uses another. Customer support uses a third. Nobody has a comprehensive inventory. That inventory is literally step one.
High-risk AI systems must be evaluated for discriminatory outcomes across demographic groups. This is not a box-checking exercise. It requires:
The uncomfortable reality: every AI system tested carefully has shown some form of bias. The question is not whether your system has bias. It is whether you know what it is and whether you have made defensible decisions about what is acceptable.
The Act requires meaningful human oversight of high-risk decisions. "Meaningful" is important. A rubber-stamp review where a human clicks approve in two seconds is not meaningful oversight. The regulation requires that humans have the capability, time, and information to genuinely evaluate AI recommendations.
This has product design implications. If your AI system surfaces recommendations, the interface needs to surface enough information for a human to evaluate those recommendations critically. If you are using AI for hiring screening, the reviewer needs to see enough about the candidate to form an independent judgment, not just an AI score.
People have a right to know when AI has made a significant decision about them and to request human review. This applies to consequential decisions: credit, employment, healthcare, insurance, education. You need processes for these requests and ability to execute them.
Here is the framing that changes how you think about compliance investment.
Companies that invest in compliance infrastructure early do not just reduce regulatory risk. They build capabilities that have independent value.
Bias testing improves your product. A hiring AI that treats candidates equitably not only reduces legal risk but makes better hiring decisions. The bias evaluation infrastructure you build for compliance reveals product quality problems you would have missed otherwise.
Documentation helps your engineering team. Writing down which models you use, why, and how they perform creates institutional knowledge that prevents expensive reinvention. When a model changes or needs replacement, documented rationale makes the decision faster and better.
Risk assessments prevent actual risks. The exercise of systematically thinking through what could go wrong with each AI deployment surfaces problems before they become incidents. This is valuable regardless of regulation.
Enterprise sales close faster. Enterprise customers in regulated industries (finance, healthcare, legal, government) increasingly require AI governance documentation from vendors. Your compliance posture directly affects your ability to close deals.

Conduct an AI inventory. Every model, every use case, every team using AI in any form. This is harder than it sounds because AI adoption is decentralized. You will find things you did not expect.
For each AI system, record:

Bring legal counsel into this process. Not to do the classification for you, but to review your classifications and flag potential mismatches.

Join industry working groups in your sector. Regulatory guidance is still being written. Companies at the table when guidance is developed have significant advantages in both shaping it and understanding it.
Track regulatory developments quarterly. The landscape is evolving. US state legislation, sector-specific guidance from financial regulators and healthcare regulators, and EU enforcement actions will all shape the practical compliance landscape.
Regulatory enforcement for AI will follow the GDPR pattern with one important difference: the cases that establish precedent will not be against the smallest violators. They will be against visible companies with clear violations that make compelling examples.
If your AI system makes consequential decisions, lacks human oversight, and produces demonstrably biased outcomes, you are a compelling enforcement target. The fine does not need to be existential to be devastating. A 15 million euro fine plus the reputational cost of being the headline example is enough to reshape your company's trajectory.
Invest now. Voluntarily. On your own timeline.
